Rental Conditions EN

1.           Preamble

The lessee concludes a rental agreement with the Lessor. The rental object is used for parachuting.

2.           Object of Hire

  • The contract concerns the object:
    • See invoice with serial number of the item
  • Period of use: Unlimited number of jumps / 1 year / period of validity 01.01. – 31.12.

(Period also applies if the rental item is delivered by mid-April due to new orders from the manufacturer. This does not restrict seasonal use).

  • Amendments to the contract shall be made in writing.
  • During the term of the contract, the Leesee has the option of switching between other models of a rental item in the same product group (e.g. downsizing or upsizing of umbrellas), provided these are available.
  • During the term of the contract, the Lessee has the option of switching between the Non-Cross Braced, Cross Braced and Cross Braced + categories.
  • A change will result in a subsequent charge or a credit note (NCB cheaper than CB and CB cheaper than CB+).

3.           Duration and Payment

  • The rental object shall be handed over at the registered office of westsky GmbH in Dornbirn, where the rental object shall also be returned upon expiry of the contract.
  • The rental agreement is concluded for a period of 1 year. If the rental object is newly purchased and delivered during the year, e.g. in January, February or March, the full rental price must still be paid. The Lessor may offer a discount for later deliveries at his own discretion.
  • The Lessee shall pay the total amount in advance.
  • The Lessee is liable for the destruction of the rental object. The rental object is not covered by comprehensive insurance.

4.           Right of Cancellation

  • The Lessee may cancel the contract in writing within seven days.
  • The cancellation period begins as soon as the renter signs the contract.

5.           Insurance

  • The Lessor must insure the rental object, if it is a main parachute, in his name with his liability insurance company. The liability insurance applies worldwide, with the exception of the USA, US territories and Canada. The liability insurance for these countries is the responsibility of the Lessee.
  • The Lessee confirms the assumption of the replacement costs in the event of the destruction of the rental object.

6.           Use / Maintenance of the Rental Object

  • Maintenance costs such as Reline for the canopy and 5 or 10-year maintenance for the AAD (e.g. Cypres) are borne by the Lessor.
  • CB+ canopies are relined every 2 years. If the number of jumps made by the hirer on the rental canopy leads to an earlier reline, the costs are to be borne by the Lessee. A reline may only be carried out by the Lessor or by a rigger authorised by the Lessor.

  • The Lessee undertakes to use and maintain the rental object entrusted to him with care. Unreasonable wear and tear will be charged to the Lessee.

  • The operating instructions contain safety information that the Lessee must respect.

  • The Lessee must have repairs carried out immediately after a defect or damage occurs. This applies in particular to accidental damage.
  • The Lessee must have all service and repair work carried out by the Lessor or by a rigger authorised by the Lessor.
  • Accidents, cases of damage and the loss of the rental item must be reported to the Lessor immediately.
  • The Lessee may allow other persons to use the rental object, provided they hold a valid skydiving licence.

7.           Termination of the Contract

  • The Lessor is entitled to terminate this contract at any time without notice if the Lessee fails to fulfil his contractual obligations.
  • At the end of the agreed term, the Lessee must return the rental object to the Lessor in a condition that is suitable for the contractual use.
